Terms and Conditions 1. For the purpose of the paragraphs below: "MDS" shall mean collivery.co.za an operating division of MDS Holdings (Pty) Ltd, its staff, agents or sub contractors. "Goods" shall mean any documents, parcels or freight accepted for carriage by the MDS. "Carriage" shall mean the transport of goods from one point to another by the carrier. "Client" shall mean the party responsible for the payment for the carriage of the goods. "Owner" shall mean the party who has a financial interest in the goods. "Parties" shall mean the client, the owner, the sender the receiver or the carrier. "Waybill" is the accompanying document which identifies the client, the number and weight of packages involved and instructions regarding the time and place of both the collection and delivery, copies of which are signed by the parties and serves as proof of handover of the goods from one party to the other. 2. MDS is not a public / common carrier and has the right to refuse to accept for carriage any goods without giving any reason for refusal. 3. MDS' prices for its services are set out in its price list or are as negotiated or quoted to the client and are subject to review from time to time. 4. Prices quoted are based on the information provided by the Client. Should this information be found to be incorrect, MDS has the right to adjust the prices based on the correct information while continuing with the carriage. 5. MDS' liability to the client in respect of goods in its care: 5.1 Will terminate once proof of delivery has been obtained from the receiving party stated on the waybill. 5.2 Shall be limited to an amount of R100.00 (one hundred Rand) unless the insurance option has been selected. 5.3 Shall exclude indirect and consequential damages. 6. MDS shall not be liable for failure to fulfil it's obligations if such failure is due to war, civil disobedience, industrial dispute, act of God, or any event beyond MDS' reasonable control. 7. If MDS is unable for any reason to effect delivery of the goods, all reasonable steps will be taken to return the goods to the client. The client will be responsible for the costs of carriage, attempted delivery and the return of the goods. 8. In the event of a dispute the client agrees to the jurisdiction of the Magistrates Court . 9. MDS will not be responsible for any fulfilment of Customs formalities or payments. However MDS will assist the client as far as possible, on condition that such assistance will be rendered at the sole risk and responsibility of the client. The client undertakes to indemnify MDS and hold it harmless against any claims in this respect. 10. The client warrants that: The goods are accurately described on the waybill. The goods are adequately packed and addressed to enable delivery to take place with ordinary care and handling. The client has to the best of its knowledge and belief, complied with all laws, rules and regulations regarding the carriage and that the goods are not prohibited by Government regulation. 11. These Terms and Conditions represent the entire agreement between the parties. Any changes to the conditions shall be agreed between the parties and reduced to writing. DELIVERY POLICY
Warranty issues and manufacturer restrictions prevent us from delivering certain products to all geographical locations. You will be notified while placing your order if we are unable to deliver specific items to the address you've selected. Below are some general guidelines for items shipped by Music Connection to the following destinations:

All items of the Music Connection site have an indication of the delivery time, usually 10 to 15 working days.

Outside the borders of South Africa

The customer must arrange own delivery / shipping for any items purchased

All goods to international addresses are sent via Courier Services. Delivery usually takes place within 3 or 4 weeks after dispatch - however, seasonal peaks and delays at customs etc is outside the control of Music Connection and deliveries may take up to six weeks.
The costs are determined on an ad hoc basis. Note that such costs are normally very high.

Import Duties
Import duties may be payable by recipients of goods in foreign countries. Music Connection does not know what levies may be payable and cannot calculate or estimate such costs.

AGREEMENTS OF SALE

Placing an item in a shopping basket without completing the purchase cycle does not:

constitute an agreement of sale between Music Connection and users cannot hold Music Connection liable if such items are not available when the purchase cycle is completed later; and/or
constitute an order for such an item; and
Music Connection may remove such an item from the shopping basket if no stock is available.
An agreement of sale between Music Connection and a user only comes into effect if and when:

A credit card authorisation is received from the issuing bank
Music Connection reserves the right to refuse to accept and/or execute an order without giving any reasons. Music Connection also reserves the right to cancel orders in whole or in part as circumstances dictate. Music Connection shall only be liable to refund monies already paid by the user. Music Connection shall take all reasonable efforts to maintain correct prices. However, should errors occur and items are offered at incorrect prices, Music Connection will not be obliged to sell goods at such incorrect prices and shall only be liable to refund monies paid.

Stock Availability

Stocks of all goods on offer are limited. Music Connection shall take all reasonable efforts to discontinue the offer as soon as stock is no longer available. However, should items still be offered after stocks are sold, Music Connection shall only be liable to refund monies where it is unable to fulfill orders at advertised prices.

Export Restrictions

Music Connection is not permitted to sell internationally produced music outside the borders of South Africa but music by South African artists can be sold internationally.
